Terms of service
Last updated: October 2026
1. Scope
These terms govern the use of Smallwerk and all online services (software as a service) offered under it by Mindcaptain Services OÜ, Ahtri tn 12, 15551 Tallinn, Harju County, Estonia ("we"). The services are intended exclusively for businesses and professionals acting in a commercial or independent professional capacity (entrepreneurs within the meaning of § 14 BGB). By subscribing to a paid plan you confirm that you act as a business.
2. Services and plans
- Formlane: a form backend that receives, stores and forwards form submissions from customer websites. Free $0/month · Starter $8/month · Pro $19/month
Free plans are limited to the stated monthly quota and may show a "Powered by" notice. Databases are located in the EU (Frankfurt); the providers we use are listed in the privacy policy. We continuously improve the services; we will not materially reduce core features of a paid plan during its term without notice.
3. Prices and payment
Prices are exclusive of VAT where applicable. Payment is monthly in advance via our payment provider Stripe. We announce price changes at least 30 days in advance by email; you may cancel effective at the change.
4. Term and cancellation
Subscriptions run monthly and can be cancelled at any time effective at the end of the current billing month, in the customer portal or by email to hello@mindcaptain.com. The right to terminate for cause remains unaffected. After the contract ends you can export your data for 30 days; afterwards it is deleted.
5. Customer obligations, abuse
Keep your access secure and use the services lawfully. In particular, do not process spam, phishing or unlawful content through them. We may suspend the affected service in case of abuse. You are responsible for content you or your users submit.
6. Data protection
For your users' data we act as your processor under Art. 28 GDPR; a data processing agreement can be requested at the contact address. Details in the privacy policy.
7. Availability
We aim for high availability. Short interruptions due to maintenance, updates or provider incidents cannot be ruled out.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to the typical, foreseeable damage and at most to the fees paid in the last 12 months. Otherwise liability is excluded.
9. Changes to these terms
We announce changes at least 30 days before they take effect by email. If you disagree, you may cancel effective at the change.
10. Final provisions
The law of the Republic of Estonia applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country of your registered office remain unaffected. If a provision is invalid, the rest of the contract remains valid.
